General Terms and Conditions (GTC)
1. Scope
These General Terms and Conditions (GTC) apply to all orders placed via the FANBOX.CH online shop.
They apply to all products and services offered in the online shop, regardless of the type, design or future expansion of the product range, in particular, but not exclusively, to:
Mystery products (e.g. mystery boxes, mystery cards, bundles)
Accessory products (e.g. jersey frames, card sleeves, displays, storage)
Vouchers (digital or physical)
By placing an order, the customer agrees to these terms and conditions.
2. Conclusion of contract
The presentation of products in the online shop does not constitute a legally binding offer. By submitting the order, the customer makes a binding offer to conclude a purchase contract. The contract is concluded as soon as FANBOX.CH confirms the order by email or dispatches the goods.
3. Legal capacity
Orders may only be placed by persons with full legal capacity (aged 18 and over) or with the consent of a legal representative. By placing an order, the customer confirms that they meet this requirement.
4. Mystery box & mystery product concept
FANBOX.CH offers so-called mystery products. These include, but are not limited to:
Mystery boxes with football shirts
Mystery card products (e.g. collectible cards, trading cards)
Mystery bundles or special editions
Future mystery products whose contents are wholly or partially unknown at the time of purchase
The contents of all mystery products are randomly assembled. The customer has no influence on the selection, design, brand, club, player, edition, colour, condition or other characteristics of the items contained, unless expressly stated otherwise.
All items contained in mystery products are original products. Images in the online shop are for illustrative purposes only. Deviations between images and actual contents are possible and do not constitute a defect.
Unless expressly stated otherwise, there is no entitlement to a specific minimum value, a specific rarity, edition or a guaranteed individual item. The value of individual items contained may vary and is not a reason for complaint or return.
The mystery character – in particular the random composition and the unknown content – is an essential part of the purchase contract and is expressly accepted by the customer when placing the order.
5. Prices and payment
All prices are quoted in Swiss francs (CHF) as standard. Unless expressly stated otherwise, prices are not subject to VAT, as FANBOX.CH is currently not subject to VAT (in accordance with Swiss VAT law).
For customers outside Switzerland, prices can also be displayed in euros (EUR). These serve as non-binding guidelines.
The binding price is quoted at the time of payment processing by the respective payment provider (e.g. credit card company, PayPal). Any fees for currency conversions or foreign transactions are borne by the customer.
The available payment methods are displayed during the ordering process.
Pricing errors: Should obvious pricing errors occur despite the utmost care due to technical or human error, FANBOX.CH reserves the right to contest the contract. In this case, any payments already made will be refunded in full.
6. Delivery and shipping
Delivery is made to the countries selectable in the order process (checkout). The available delivery countries are displayed to the customer during the order process.
Delivery times may vary depending on the destination country, shipping method and payment method. Unless otherwise stated, shipping usually takes place within 3–7 working days after receipt of payment. Delivery times are non-binding estimates.
The shipping costs incurred are displayed transparently at checkout and are binding before the order is completed.
Customs duties, taxes and import duties: For deliveries abroad (e.g. EU), additional customs duties, taxes or import duties may apply. These are borne exclusively by the customer and are not included in the purchase price or shipping costs.
Partial deliveries: FANBOX.CH is entitled to deliver orders in partial deliveries, provided this is reasonable for the customer. This does not result in additional shipping costs.
7. Returns & right of withdrawal
There is no statutory right of withdrawal in Switzerland.
FANBOX.CH voluntarily grants a right of return within 7 days of receipt of the goods, provided that the products are unopened, undamaged and in their original packaging or original sealed packaging.
The following are excluded from the right of return:
Opened or damaged mystery products
Mystery products with removed seals
Vouchers (digital or physical)
Used or damaged accessories
The customer shall bear the return costs, unless otherwise agreed.
Mandatory consumer protection provisions of the customer's country of residence remain reserved.
8. Warranty
The provisions of the Swiss Code of Obligations apply.
The warranty period is 24 months from receipt of the goods, unless otherwise required by law.
The warranty is limited, at the discretion of FANBOX.CH, to:
Rectification (repair) or
Replacement delivery
A conversion or reduction is excluded, as far as legally permissible.
Obvious defects must be reported in writing within 14 days of receipt of the goods. If the customer fails to report defects in good time, the goods shall be deemed to have been approved.
Mandatory consumer protection provisions of the customer's country of residence remain reserved.
9. Liability
FANBOX.CH shall only be liable for damage caused by intent or gross negligence.
Liability for slight negligence, indirect damage, consequential damage or loss of profit is excluded to the extent permitted by law.
10. Vouchers
Unless otherwise stated, vouchers are valid indefinitely and do not bear interest. Cash payment is excluded. Vouchers can only be redeemed in the FANBOX.CH online shop.
11. Force majeure
FANBOX.CH is not liable for delays or non-performance due to events beyond its control, in particular natural disasters, pandemics, war, strikes, official orders, supply chain disruptions or technical malfunctions.
12. Data protection
Personal data is processed in accordance with the FANBOX.CH privacy policy and the applicable Swiss data protection laws (revDSG).
13. Applicable law and place of jurisdiction
Swiss law applies exclusively.
For consumers, the mandatory places of jurisdiction under Swiss law and, where applicable, the mandatory provisions of the country of residence apply. For all other disputes, the registered office of FANBOX.CH shall be the exclusive place of jurisdiction.
14. Currency conversions
All prices are binding and quoted in CHF. Amounts displayed in EUR are for reference purposes only and are not binding.
The final conversion is carried out by the respective payment provider. FANBOX.CH accepts no liability for exchange rate fluctuations or additional fees.
15. Final provisions
Should individual provisions of these GTC be invalid or unenforceable, the validity of the remaining provisions shall remain unaffected. FANBOX.CH reserves the right to change these GTC at any time.
